Legislative Summary
Federal and state laws provide protection against discrimination on the basis of disability in post-secondary education. Under the Americans with Disabilities Act and Section 504 of the Rehabilitation Act of 1973, individuals with disabilities are guaranteed certain protections and rights of equal access to programs and services. The Americans with Disabilities Act of 1990 (ADA) was enacted to protect individuals with disabilities against discrimination in such critical areas as employment, housing, public accommodations, education, transportation, communication, health services, and access to public services.
The ADA defines disability as "a physical or mental impairment that substantially limits one or more major life activities, a record of such impairment, or being regarded as having such an impairment." Disabilities involve permanent substantial limitations and are distinct from common conditions not substantially limiting major life activities.
